First of all, thats for Windows XP - Also to query a modem, you don't need your phone line plugged in to query a modem, as your'e only checking the modem and NOT the phone line

By the sounds of it, the modem is not configured properly and / or Windows not playing ball and just doesn't like the modem drivers.
Try and get updated drivers for this modem you've just brought.
