I just got a call from toshiba today which was a surprise as they do say that they do quality assurance checking. But it was interesting as it was in respect to the BIOS and whether I had gone ahead with the sp2 install and of course I said no. They simply indicated that they were doing followups. At the moment they still maintain that there is no issue with toshiba. Thought that I should post this for whatever it is worth for other members.
