Downloading/uploading on file sharing programs e.g emule, edonkey

Hi,
Can some one tell me if you can get caught for uploading portions of files you haven’t finished downloading yourself? Like on emule when you've downloaded lets say 5 megs of a file emule will share that portion of the file to other users where it uploads it against your will but the actual file which could be 30 megs isn't in your shared folder yet because you haven’t finished downloading it yourself. And does any one know any programs that don't do this besides kazaa.

Thanks any info is grealty appreciated.

Reeper47,, let pretend the software people download would be car and emule and Kazza are the chop-shop,,,
now you tell us, if you go around town and still car part and bring it to your chop-shop and put it together and make a new car,, would that be illegal ? It does not matter how big the file you have downloaded, basically that file belong to the company who made it and you could be responsible for having it whether it is 5 Meg file or a seat cover for a car

By the way I would not use logo such as this "

yeah, is there any good downloading file sharing programs that are better and safer than kazaa?
